Individual solicitor status

Phrasing Legal is led by Muhammad Arshed, a solicitor of England and Wales, SRA No. 833553, admitted 3 April 2023. The solicitor is individually authorised and regulated by the SRA.

The solicitor’s individual regulation does not extend SRA firm authorisation to Phrasing Ltd or Phrasing Legal. Before substantive work begins, we explain whether the work will be personally provided or supervised by the regulated solicitor and what that means for complaints and regulatory protections.

Services supplied through Phrasing Ltd

Phrasing Legal provides clearly defined non-reserved legal services through Phrasing Ltd. We assess the substance of the requested task before accepting instructions. A service label does not determine whether an activity is reserved or separately regulated.

Reserved legal activities

Phrasing Legal does not undertake reserved legal activities. These include rights of audience, conduct of litigation, reserved instrument activities, probate activities, notarial activities and administration of oaths. Where a matter requires an authorised provider, the client remains responsible for instructing one unless a separate arrangement is expressly agreed.

Immigration and asylum enquiries

Immigration advice and immigration services are separately regulated. Phrasing Ltd is not registered with the Immigration Advice Authority and is not intended to provide substantive immigration work through Phrasing Legal. The individual solicitor’s SRA status does not by itself permit immigration work to be supplied to the public through Phrasing Ltd. The website therefore limits immigration and asylum activity to general information, factual routing, signposting and authorised-provider referral. Phrasing Legal does not assess eligibility, recommend a route, prepare or submit immigration applications, draft substantive immigration or asylum representations, correspond with the Home Office as representative, prepare reviews or appeals or provide immigration advocacy through Phrasing Legal. Any substantive work is supplied under a separate retainer by an appropriately authorised provider.

Claims-management and FCA boundaries

Phrasing Ltd does not undertake regulated claims-management activity unless the necessary FCA permission, legal-regulator route or other lawful exemption applies. Particular care is taken with employment-related claims and housing-disrepair claims. Our employment service is focused on contracts, internal workplace processes, grievances, disciplinary matters, redundancy consultation and other work that can lawfully be provided within scope. Our housing service does not include regulated housing-disrepair claims-management activity.

Professional indemnity insurance

Phrasing Ltd is not required to maintain professional indemnity insurance that complies with the SRA Minimum Terms and Conditions applicable to SRA-authorised law firms. Before you formally instruct us, you will be told in writing whether the proposed work is covered by alternative professional indemnity insurance and, on request, the relevant scope and amount of any cover.

SRA Compensation Fund

Clients cannot make a claim on the SRA Compensation Fund in respect of services supplied through Phrasing Ltd. The Compensation Fund protections associated with an SRA-authorised law firm do not apply to Phrasing Ltd.

Client money

Phrasing Legal does not operate an SRA client account. Money should never be paid into an account held personally by the individual solicitor. Where a third-party cost or other payment is required, the payment arrangement will be explained in writing.

Legal professional privilege

Legal professional privilege is fact-specific. Confidential communications between a client and a legal professional for the dominant purpose of giving or receiving legal advice may attract legal advice privilege. However, work supplied through an unregulated business is not automatically privileged, and privilege may not apply to communications or work involving non-lawyers. If privilege is important to your matter, we will identify that issue before substantive instructions are accepted and explain whether a different authorised route should be considered.

Complaints, Legal Ombudsman and SRA

Phrasing Legal maintains an internal complaints procedure. Where a service is personally provided by, or under the responsibility or supervision of, the SRA-regulated solicitor, an eligible client may have a right to complain to the Legal Ombudsman about that legal service. Work supplied solely by a non-authorised person and outside the solicitor’s responsibility or supervision may not fall within the Legal Ombudsman’s jurisdiction. Professional-conduct concerns about the individual solicitor can be reported to the SRA.

Referrals, divided work and professional connections

If reserved, specialist or separately regulated work is required, we may suggest an appropriately authorised provider. This can include the formal Family Court stage, court or tribunal representation, conveyancing or Land Registry work, probate application work, substantive immigration services, regulated claims work or another activity that Phrasing Legal cannot lawfully provide.

Muhammad Arshed is currently listed by the SRA as working at a separate SRA-authorised practice that may, where suitable, be offered as an optional referral route. the suggested firm is separate legal businesses from Phrasing Ltd. The professional connections are disclosed so that you can make an informed choice. You are under no obligation to instruct the suggested firm and may choose any appropriately authorised provider.

The receiving firm independently decides whether it can accept the matter, performs its own conflict, client-identification, AML, competence and risk checks as applicable, issues its own client-care letter and terms, and confirms its own fees, insurance and complaints arrangements. Responsibility for a matter or deadline does not move to the receiving firm until it expressly confirms acceptance.

Phrasing Legal does not charge a separate referral fee merely for an introduction. If any financial or other interest or fee-sharing arrangement becomes relevant to a particular referral, it will be disclosed in writing where required before the client decides whether to proceed.
