Single Justice Procedure Notice: Practical First Steps

What to organise when an SJPN arrives and why the response deadline matters.

A Single Justice Procedure Notice can require a response within a stated period. The first task is therefore to identify the allegation, the response deadline and the documents that explain what is said to have happened.

Read every page of the notice

Identify the offence or offences, the alleged date, the prosecution summary and any witness or documentary evidence supplied. Do not assume that all allegations raise the same issue.

Separate plea from mitigation

Whether an allegation is admitted is a different question from what should be said about circumstances, sentence or financial information. Avoid sending a narrative before understanding what it may imply about the allegation.

Collect the relevant records

Depending on the case, useful material may include driving records, correspondence, proof of insurance or ownership, previous nominations, photographs and documents relevant to personal mitigation.

Identify any inconsistency early

If information previously provided to the police or another authority may have been inaccurate, obtain individual advice before making a further statement. The legal consequences can depend heavily on the facts.
